737.07 POSTING OF SIGNS; PROHIBITION OF ASHTRAYS; RESPONSIBILITIES OF PROPRIETORS.
   In addition to the prohibitions contained in Section 737.03 of this chapter, all proprietors of places of public assembly shall comply with the following requirements on or before August 1, 2005:
   (a)    "No smoking" signs or the international "no smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) shall be clearly and conspicuously posted and maintained at all times on or near all public doorways to every place of public assembly and within such spaces where smoking is prohibited by this chapter. A sign shall be of sufficient size to be clearly legible to persons entering or frequenting the area it is intended to mark. All signs shall contain a telephone number for reporting violations.
   (b)    All ashtrays and other receptacles used for disposing of smoking materials shall be removed from any area where smoking is prohibited by this chapter unless such ashtrays or receptacles are for ornamental purposes only and are displayed in such a manner so as to preclude their use as receptacles for the disposal of smoking materials.
   (c)    This section shall not be construed to permit smoking in any area in which smoking is prohibited pursuant to Section 737.03 .
   (d)   Proprietors of places of public assembly which are permitted to remain as smoking establishments under Section 737.02 (a)(1) shall post signage advising that they permit smoking on or before August 1, 2005.
   (e)   The City of Fairfield shall provide the signage required by this section at its expense. Any other provisions of these codified ordinances notwithstanding, no permit for the posting of signage under this chapter shall be required and such signage may be posted by persons other than licensed sign erectors.
