953.01   SERVICE FEE FOR RESIDENTIAL GARBAGE AND SOLID WASTE COLLECTION AND RECYCLING.
   (a)   In order to provide necessary funds for costs incurred in connection with the collection, disposal and recycling of residential garbage and solid waste in the City of Fairfield, a monthly service fee is hereby charged to every residential unit in the City, whether single family or multi-family or mobile home, based upon whether curbside or dumpster (including compactors) service is provided, as follows:

   (b)   The service fee described in subsection (a) hereof shall be billed and collected as part of the utility bill of the City. Nonpayment of the utility bill shall result in the termination of all utility service, including water and sewer service. In the event that the property is not served by Fairfield water or sewer service, the service fee shall be billed to the property owner or resident.
   (c)   There is hereby established a separate fund to be known as the "Solid Waste Management Fund" into which fund all service fees collected under this chapter shall be deposited.
   (d)   For purposes of the service fee provided in subsection (a) hereof, vacant residential units are presumed not to generate garbage or solid waste and shall be exempted from the payment of the monthly fee as hereinafter provided. Residential units which are served by separately metered water and/or sewer service billed by the City, which service is terminated, shall be presumed to be vacant for the period of such termination and the property owner shall be exempted from the payment of the monthly service fee for any complete calendar month of such vacancy. As to residential units which do not receive separately metered water and/or sewer service billed by the City, the property owner(s) or agent may apply for an exemption of the monthly service fee for such vacant residential units. The application shall be made under oath or affirmation on forms provided by the City and shall contain such information as the Director of Finance determines is necessary to properly verify the vacancy and identification of the billing account to which the requested exemption applies. Such forms must be received in the Department of Finance on or before the fifth business day of each month following a complete calendar month that the residential unit is vacant except that forms for any calendar months of 1993 must be filed no later than the fifth business day of January, 1994.
   (e)   For purposes of this chapter, the following definitions shall apply:
(1)   "Residential unit" means any dwelling unit which is constructed as a separate household unit whether as a single family building or as one unit of a two, three, four or other multi-unit residential building. Residential unit includes mobile homes and modular homes. Residential unit does not include hotel and motel rooms and sleeping rooms not constructed as a separate household unit under the Fairfield Building Code.
(2)   "Vacancy" or "vacant" means a residential unit which is not occupied by any person for at least one calendar month. Residential units which are leased or rented shall be presumed to be occupied and not vacant unless the residential unit is served by separately metered and billed water and/or sewer service and such service has been terminated.
