529.08 CONDUCT OF LICENSED ESTABLISHMENTS.
   (a)    Unlawful Acts. 
      (1)    No owner, manager or person in charge of liquor license establishments shall permit any disturbance or unlawful or disorderly act or conduct to be committed by any person or group of persons upon any premises licensed for the sale of spirituous, vinous or malt liquors or beverages.
      (2)    No owner, manager or person in charge of liquor license establishments shall, in any manner, encourage or participate in any disturbance or unlawful or disorderly act or conduct within any establishment selling spirituous, vinous or malt liquors or beverages; provided, however, that such owner, manager or person in charge may use such lawful means as may be proper to protect his person or property from damage or injury.
   (b)    Reports. Any owner, manager or person in charge of liquor license establishments shall immediately report to the Police Department any unlawful or disorderly act, conduct or disturbance on the premises.
   (c)    Prosecution; Conviction. Prosecution or conviction under this section shall not prohibit prosecution or conviction under any other applicable law or ordinance, and the penalties provided shall be accumulative and in addition to all other penalties incurred under such other applicable law or ordinance enacted by the City.
   (d)    Absence Not An Owner's Defense. It shall not be a defense that the owner was not personally present at the establishment at the time any unlawful or disorderly act, conduct or disturbance took place; provided, however, that an agent, servant or employee of the owner shall not be responsible hereunder when absent from the establishment while not on duty.
   (e)    Whoever violates this section is guilty of permitting a disturbance within an establishment licensed for the sale of alcoholic beverages, a misdemeanor of the second degree.
