674.07  NOTICE TO OWNER TO REMOVE DEAD, DYING OR FALLEN TREES OR TREE LIMBS; SERVICE.
   (a)   The Building Commissioner is hereby authorized and directed to make inspections to determine the condition of all trees and tree limbs on private property and to enforce the provisions of this chapter regarding trees and tree limbs on private property.
   (b)   Inspection and Entering Premises. The Building Commissioner has the power to enter any premises at a reasonable time to inspect suspected or reported violations of Section 674.06. Should the owner or occupant of any building or premises refuse reasonable requests of the Building Commissioner or his duly authorized agent to enter the property, the Building Commissioner shall not enter the building or premises without first obtaining a warrant or other order from a court of competent jurisdiction.
   (c)   Order for Removal of a Violation. If violations are found, the Building Commissioner shall order, in writing, the remedying of the violations. Each order issued under this section shall be served on the owner or occupant of the premises where the violation is found, or posted on the premises when the violation is found. Each such order shall also provide a reasonable time, not to exceed 60 days, to remedy the violation. The order shall set out the date it was issued and the date by which the violation shall be remedied.
   (d)   Penalty. Any property owner who fails to comply with the notice of the Building Commissioner given pursuant to this section is guilty of a minor misdemeanor. Punishment shall be as provided in Section 698.02. Each day a violation continues is a separate offense.
