(a) Removal of Dead or Dying Trees and Tree Limbs Required. Trees or tree limbs on private property which are dead, fallen, or otherwise in bad condition, to which any of the following circumstances apply, are a public nuisance and shall be removed or caused to be removed by the owner of the property:
(1) Trees or tree limbs on private property which are dead, fallen, or otherwise in bad condition, and that are overhanging or posing a hazard to adjacent private property;
(2) Trees or tree limbs on private property which are dead, fallen, or otherwise in bad condition, and that are overhanging or posing a hazard to public property or public thoroughfares; or
(3) Trees or tree limbs on private property which are dead, fallen, or otherwise in bad condition, and that are obstructing or are in danger of obstructing culverts, covered drains, any natural watercourse, creek, brook, or branch, in such a manner as to impede the water naturally flowing therein.
