610.05  EMISSION LIMITATION; VISIBLE BLACK PLUMES.
   (a)   (1)   No person shall cause or permit the emission of a plume of smoke or other particulate matter which has a density appearing as dark or darker than No. 2 on the Standard Smoke Chart except that an emission for not more than five minutes of No. 3 on the Standard Smoke Chart in any one hour will be permitted for normal operations of start up, fire cleaning and flue blowing.
      (2)   For purposes of this chapter, the Standard Smoke Chart is the Ringelmann Chart, as published by the U.S. Bureau of Mines, photographically reduced in size for use in the field. The Power's Micro-ringelmann Chart, a copy of which is retained in the Office of the Air Pollution Control and Heating Engineer, shall be considered to meet these requirements.
      (3)   In the operation of railroad locomotives, allowance shall be made for periods of dense smoke emission as follows:
      (4)   Only one allowance, not to exceed a continuous period of six minutes shall be made for building or lighting of a wholly fresh fire or for cleaning or withdrawing the fire in any particular locomotive.
      (5)   In operating service, whether moving or standing, allowance shall be made for any period or periods of dense smoke emission of not more than one minute per hour in the aggregate.

   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
