(A) An animal determined to be vicious may be humanely destroyed by any Animal Control Officer or peace officer when any of the following occur:
(1) After proceedings conducted under §§ 91.1001 et seq., it is determined that the release of the animal would create a significant threat to the public health, safety, or welfare.
(2) An owner of an animal that has previously been determined to be a vicious animal violates the provisions of this subchapter relating to the keeping of vicious animals.
(3) An animal that has previously been determined to be a vicious animal, when unprovoked, attacks, wounds, bites, or otherwise injures or kills any person.
(B) An animal may not be destroyed pursuant to divisions (A)(2) and (3) hereof without a hearing pursuant to §§ 91.1001 et seq.
