§ 130.01 DRINKING INTOXICATING BEVERAGES IN PUBLIC.
   (A)   Except as provided by § 115.05, and division (B) below, it shall be unlawful for any person to drink or possess upon his or her person an open container of any intoxicating beverage as defined in § 115.05(B) upon any sidewalk, street, alley or other public place in the city.
   (B)   It shall not be unlawful to drink intoxicating beverages at a special event provided a Special Event Permit has been issued by the City of Eureka, and the event operator complies with all regulations of the California Department of Alcoholic Beverage Control including possession of an appropriate license to serve intoxicating beverages.
