(a) No person in charge of any boat in operation in any waterway or moored at any wharf, dock or pier shall allow the same to operate or to remain during the nighttime unless properly lighted in compliance with the requirements of Ohio R.C. 1547.02.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree and shall be subject to the penalty provided in Section 599.02.
