(a) Whoever violates or fails to comply with any provision of this chapter shall be issued a warning citation for a first violation. A copy of the rules or regulations for garage sales shall be included with the warning citation and the delivery of the rules noted on records kept by the Housing Department.
(b) Whoever violates or fails to comply with any provision of this chapter shall be issued a noncompliance citation for a second violation at the same address. Such noncompliance shall include an assessment fee of thirty-five dollars ($35.00). The fees shall be paid to the City within 30 days of issuance.
(c) Whoever fails to comply with division (b) of this section or violates or fails to comply with any provision of this chapter for a third or subsequent time at the same address is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred and fifty dollars ($250.00) or imprisoned not more than 30 days, or both, for each offense.
(d) The imposition of any penalty shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an illegal or unlawful act, conduct, or use, in or about any premises, or to require compliance with the provisions of this chapter.
