1105.01 STANDARDS ESTABLISHED.
   An abortion otherwise permitted by law may be performed only by a qualified obstetrician or a qualified surgeon and then only in a recognized and accredited hospital within the City or in a facility providing the following standards and procedures:
   (a)   Laboratory procedures must be available similar to those for a hospital admission, including procedures for determining blood type and Rh factor.
   (b)   A receiving facility must be available where the patient can be prepared and where the patient can receive necessary medication before and after the operation.
   (c)   Written verification of one or more physicians of the diagnosis and duration of the pregnancy shall be provided.
   (d)   A pre-operative history shall be recorded and a physical examination particularly directed to identification of pre-existing or concurrent illnesses or drug sensitivities, that may have a bearing on the operative procedures or the anesthesia, shall be made.
   (e)   An operating room equipped to conduct the operation safely and to provide for emergency use of blood, oxygen, anesthesia and resuscitation shall be provided. It shall be constructed and maintained in such a manner that it shall be free from sanitary hazards and safety hazards likely to cause a fire or explosion. Environmental control shall be established to prevent infection, including the control of personnel and patient traffic.
   (f)   The external identification of such facility shall conform to the provisions of the code of ethics of the national professional organizations of those physicians performing services within such facility.
   (g)   Proper anesthesia service administered by a licensed physician or a nurse anesthetist supervised by a licensed physician shall be provided.
   (h)   A recovery facility staffed with at least one registered nurse in attendance at all times shall be provided.
   (i)   Adequate permanent records of each case are to be maintained and made available upon request by the County Board of Health. All individual records shall be confidential.
   (j)   All facilities shall meet the standards of the Joint Commission on Accreditation of Hospitals for the performance of all surgical procedures.
   (k)   All facilities shall require periodic inspection by the Department of Health of the City.
   (l)   Abortions shall not be performed on any patient with a gestation period of over twelve weeks, as determined by a qualified physician, except on an inpatient basis in a hospital as hereinafter defined.
