As used in this chapter:
(a) “Tow truck” means any truck or other vehicle adapted or used for the purpose of towing, winching or otherwise removing disabled motor vehicles.
(b) “Tow truck owner” means any person, firm or corporation engaged in the business of offering towing services for compensation and includes a lessee in operation of a tow truck.
(c) “Driver” and “operator” mean every person who drives or is in actual physical control of a tow truck, on a public street or public right of way within the City.
(d) “Person” means every natural person, firm, copartnership, association or corporation.
(e) “Towing” means the act of pulling or dragging any vehicle behind the tow truck which is doing the pulling or dragging. It shall also include flat bed towing. Such towed vehicle can be self supported, carried on a dolly-type platform, or be supported by any other item necessary to facilitate such towing.

(a) No owner of a tow truck shall permit such tow truck to be used for the purpose of towing within the City, unless a valid tow truck owner's permit obtained pursuant to this chapter has been issued and is in force for that tow truck.
(b) This section shall not apply when the property being towed is owned by the person doing the towing and is being transported for recreation, sport or show, or when the property being towed has been picked up outside the City and is either in the process of being delivered to a location within the City, or is being towed through the City to be delivered elsewhere.
(c) Evidence of ownership of a vehicle being towed shall be presented to any police officer upon demand and shall consist of a certificate of title or bill of sale for such vehicle.

(a) Each application for the permit as required by Section 777.02 shall be made in person at the office of the Chief of Police on forms provided, and such pertinent information as the Chief of Police may deem necessary shall be given under oath. It shall be a mandatory rejection of such application or revocation of any issued permit if any of the required application information is misrepresented or untrue.

(b) Each application for a tow truck permit shall be accompanied by a fee of twenty-five dollars ($25.00). Each original application filed on or after June 30 of each year shall be at a rate of fifteen dollars ($15.00). Permit renewals shall be at a per annum fee of twenty-five dollars ($25.00) for the original permit and ten dollars ($10.00) for each permit thereafter, if a person obtains permits for more than one vehicle. Each application for the replacement of a lost, missing or destroyed permit shall be accompanied by a fee of ten dollars ($10.00).

(c) Each application for a tow truck permit shall be accompanied by a photograph of the truck. The photograph shall be in color and show the entire length of the truck, including the markings, as to the ownership.

Upon approval of a tow truck owner's application, the Chief of Police shall issue a permit, and as evidence thereof a decal bearing the permit number. The decal shall be permanently fixed to the lower left-hand corner of the rear window of the tow truck.

All permits issued pursuant to Section 777.04 shall terminate on December 31 of each year, unless revoked by the Chief of Police. Permit renewals shall be made within thirty days prior to the December 31 termination date for the current permit.
