731.01 GASOLINE AND OIL FILLING STATION DEFINED.
   As used in this chapter, “gasoline and oil filling station” means the use of a building and premises primarily for the retail sale of gasoline and oil for delivery into vehicles using the same for fuel or lubrication, and may include the retail sale of grease, batteries, tires and motor vehicle accessories, the rendering of services and making of adjustments and minor parts replacements to motor vehicles, the washing, waxing and polishing of motor vehicles, as incidental to other services rendered, and the making of repairs to motor vehicles except repairs of a major type. Repairs of a major type are defined to be spray painting, body, fender, clutch, transmission, differential, axle, spring and frame repairs, major overhauling of engines, requiring the removal of an engine cylinder head or crankcase pan or racing the motor; repairs to radiators requiring the removal thereof; or complete recapping or retreading of tires. The term “gasoline and oil filling station” also includes any and all autowash facilities which combine the business of washing automobiles with the retail sale of gasoline for delivery into vehicles using the same for fuel. In addition to the foregoing, the term “gasoline and oil filling station” includes the incidental and/or secondary sale of prepackaged foodstuffs and various and sundry items. The term “foodstuffs” means any material made into or used as food, including packaged or wrapped food items such as candy bars, potato chips, cookies and soda pop. “Various and sundry items” shall include such items as cigarettes, cigars, ice and beverages, provided that no alcoholic beverages are to be sold and further provided that all of the foregoing items are to be sold in an enclosed structure. It is the intent of Council that the definition of “gasoline and oil filling station” be restricted to the terms contained in this section, and the use of a building and/or premises for a gasoline and oil filling station shall not be in addition to or an alternative use of any retail establishment, particularly such establishments generally known as “discount stores.” The use of a building and premises for a gasoline and oil filling station shall be subject to and permitted only so long as they are in compliance with the conditions set forth in this chapter.
