4-4-2: REQUIREMENTS:
The building inspector shall determine in his or her sole discretion whether or not a structure is required to comply with the act. If a structure is required to comply with the act, the applicant shall be responsible for all costs, expenses or fees of any kind or nature that may be incurred by the village. The village shall hire an independent consultant, at the sole cost of the applicant, to ensure that the structure is constructed according to the act. The building inspector shall provide the building permit applicant ("applicant") with information regarding the consultant the building inspector deems appropriate. The building inspector shall advise the independent consultant it is the consultant's responsibilities to ensure the compliance with the act by the village. The applicant, by signing the zoning application, shall agree and be fully and completely responsible for all costs and expenses incurred by the village except for the fees or salary paid to the building inspector, including, but not limited to, all fees and costs incurred by the independent consultant and all costs, fees and expenses incurred by the village in ensuring compliance with the act. The building inspector may, in his or her sole discretion, require a payment in advance prior to issuing the building permit for the estimated cost to be incurred by the applicant under this section. The applicant shall be required to pay any monies due the village or the independent consultant under the terms of this chapter within ten (10) days of receipt of a bill from the village. If the applicant fails to timely pay any monies due under the terms of this chapter, the building inspector shall have the authority to withdraw any permit issued under any village ordinance for the structure including the right to occupy the structure until all amounts required to be paid herein are paid in full and the applicant shall be responsible to pay all reasonable attorney fees, court costs, and all other expenses incurred by the village in enforcing the act or collecting any monies due from the applicant and the amount due shall accrue interest after its due date at the rate of ten percent (10%) simple interest per annum.
