A. Charges Established: There is hereby established a stormwater utility service charge for the city's stormwater drainage system at rates hereinafter established; provided, however, that the service charge shall not be imposed on the following types of property:
1. City streets, rights of way, parks, and city owned property;
2. State of Oklahoma highway rights of way;
3. Railroad rights of way;
4. Undeveloped land.
B. Monthly Rate: The monthly stormwater utility service charge rate shall be charged and collected as provided for in section 2-6E-9 of this code.
C. Application For Reduced Impervious Surface Rate: Any individually billed single-family residential user may apply for a reduced impervious surface rate for the user's individually billed single-family unit where the total impervious surface of the tract associated to the unit is less than one thousand two hundred fifty (1,250) square feet in area. Application shall be made to the customer service department on forms provided. Review of applications shall be made by the engineering department for completeness and correctness. Upon approval of application for a unit, the stormwater utility service charge rate for that unit shall be changed to the reduced impervious surface rate at the next billing cycle. At such time as the impervious surface area of a unit exceeds one thousand two hundred fifty (1,250) square feet, the standard rate shall apply and the reduced impervious surface rate shall not apply.
