1222.05 EXCEPTIONS.
   A grading permit will not be required under the following conditions:
   (a)   For the construction of a single-family or two-family structure which is located on a lot within a plat that has received final approval in accordance with the Subdivision Regulations, provided, however, that erosion and sedimentation control measures have been and are being employed in accordance with the approved grading, drainage, erosion and sedimentation control plans and specifications for the plat;
   (b)   For activity pursuant to a permit issued by the Director of Service in accordance with Section 1020.01 for work in streets or rights of way dedicated to public use, provided, however, that erosion and sedimentation control measures as approved by the City Engineer have been and are being employed;
   (c)   For authorized City capital improvement and public works projects, provided, however, that erosion and sedimentation control measures as approved by the City Engineer have been and are being employed;
   (d)   For accepted agricultural land management practices, such as plowing and construction of agricultural structures and nursery operations such as the removal and/or transplanting of cultivated sod, shrubs and trees, tree cutting at or above existing ground and logging operations leaving the stump, ground cover and root mat intact;
   (e)   For individual private septic systems which do not alter the natural terrain;
   (f)   For excavation below finished grade for basements and pads for additions to a single-family structure or for retaining walls, swimming pools or accessory buildings authorized by a valid building permit, unless a possibility for erosion and sedimentation or alteration of drainage is such as to necessitate a grading permit as determined by the City Engineer; and
   (g)   For quarry operations and the stockpiling, with slopes at a natural angle of repose, of raw or processed sand, stone and gravel at quarries, concrete, asphalt and material processing plants and storage yards, provided that sediment and erosion measures as approved by the City Engineer have been and are being employed.
