1020.01 PERMITS FOR STREET PRIVILEGES REQUIRED.
   (a)   The Director of Service is hereby charged with the construction, maintenance and repair of streets, sidewalks, sidewalk spaces, alleys, public ways and places in the City, and no person, whether an abutting owner or not, without first having obtained a permit from the Director to do so, shall do any of the following acts:
      (1)   Make any excavation or dig into any street, sidewalk, sidewalk space, alley, public way or place;
      (2)   Remove, break or make holes in any pavement of the roadway, sidewalk, or any sidewalk space or any curb;

      (3)   Place or store any personal property upon any street, sidewalk or alley, or within any right of way, except in the course of the usual and customary traffic on and over the public highways of the City;

      (4)   Construct, build, erect or place anything or any structure in, upon, over or under a street, sidewalk, sidewalk space, alley, public way or place except as specifically authorized by ordinances of the City;
      (5)   Make an improvement to the surface of any street, sidewalk, sidewalk space, alley, public way or place by grading, graveling or paving, or construct or repair sidewalks or curbs, or place or paint any sign or advertising matter on the surface of any street, sidewalk, sidewalk space, alley, public way or place, or on the surface of any overhead bridge or structure erected over or across any street, alley or public place, or make any other improvement therein; or
      (6)   Operate, park or move upon any street, alley or public way any vehicle or combination of vehicles of a size or weight of vehicle or load exceeding the maximums which can be moved without a permit as specified in Sections 440.01 and 440.02 of the Traffic Code.
   (b)   Provided, however that:
      (1)   No permit from the Director shall be required for grading or sodding lawn space located as such space may be between the property line and the curb, or for the repair of a sidewalk or driveway when such repair performed by the property owner does not exceed ten square feet in area, or for the repair of a curb when such repair does not exceed two lineal feet.
      (2)   Nothing contained in this section shall control as against the express terms of a franchise granted to a public utility to occupy the streets and public ways of the City.
