(A) Any person found to be in violation of § 97.01 shall be guilty of a violation and shall be subject to a fine of up to one hundred dollars ($100.00) for each offense.

(B) The following penalties shall be imposed for the violation of § 97.02:
(1) A first offense shall result in a 60-day suspension from utilization of the park.
(2) A second offense, within a two-year period, shall result in a six-month suspension from utilization of the park.
(3) A third offense, within a two-year period, shall result in a permanent suspension from the park.
(4) Notwithstanding the foregoing, the witnessing person or the City Council may waive penalties and provide a verbal or written warning for a first offense.
(5) In addition to all other penalties hereinabove provided, any person found to be in violation of § 97.02 shall be subject to a criminal penalty not to exceed $250 and not less than $10 before the Henry District Court.
