§ 97.01 USE OF RAILS TO TRAILS PATHWAY.
   This chapter is adopted for the purpose of regulating the use of the pathway/trail constructed along the former railroad bed between the streets of Blackaby and Zelcova Avenue in the city.
   (A)   The pathway/trail constructed along the former railroad bed between the streets of Blackaby and Zelcova Avenue shall be used exclusively for walking, jogging, running and bicycling and for no other purposes.
   (B)   Use of the pathway/trail shall be subject to the following regulations:
      (1)   No motorized vehicle shall be permitted upon the pathway/trail except for vehicles of the city, its agents or employees, as may be necessary for maintenance or for emergency services.
      (2)   The pathway/trail shall be used only between sun-up and sun-down each day. No persons shall be permitted to use the pathways/trail for any purpose except between the hours specified.
      (3)   Dogs are permitted on the pathways/trail only if properly restrained on a leash.
      (4)   Horses shall not be permitted.
      (5)   No signs, hanging objects or any other material shall be hung from or attached to the fence along the pathway/trail except those authorized by the city. No adjoining fences shall be permitted to be attached to the fence.
      (6)   No person shall be permitted to climb on or over the fence.
      (7)   Consumption of alcoholic beverages on the pathway/trail is prohibited.
   (C)   The City Council shall have the authority to pass by resolution additional regulations as may be necessary for control of the pathway/trail. Additional regulations shall be enforceable the same as if included in the text of this chapter.
