959.09 RULES AND REGULATIONS.
   The Director of Safety-Service, for the purpose of collecting and disposing of garbage, rubbish, newspapers, commingled recyclable materials and yard waste, is hereby authorized and directed to make such rules, regulations, and standards for such collection and disposal as are necessary or convenient, including the division of the City into collection districts.

959.10 COMMERCIAL COLLECTORS; PERMIT REQUIRED; TRANSPORTING WASTE. (REPEALED)
959.11 RATES FOR COLLECTION.
   (a)   The Director of Safety-Service shall charge, and every householder or other person accumulating garbage or rubbish, or both, shall pay for collection services rendered for residential premises, the following rates:
      (1)   Effective the first full billing cycle after January 1, 2018:
         A.   The sum of twenty-six dollars and fifty cents ($26.50) per month, or seventy-nine dollars and fifty cents ($79.50) per quarter. However, in the event any customer requests an additional pick-up, then there shall be a charge of twenty-six dollars and fifty cents ($26.50) for each additional such pick-up.
         B.   The charge for each additional residential pick-up, as authorized under Section 959.16, shall be twenty-six dollars and fifty cents ($26.50) per unit plus a twenty-five dollar ($25.00) crew charge.
      (2)   Effective the first full billing cycle after January 1, 2019:
         A.   The sum of twenty-seven dollars and forty-two cents ($27.42) per month, or eighty-two dollars and twenty-six cents ($82.26) per quarter. However, in the event any customer requests an additional pick-up, then there shall be a charge of twenty-seven dollars and forty-two cents ($27.42) for each additional such pick-up.
         B.   The charge for each additional residential pick-up, as authorized under Section 959.16, shall be twenty-seven dollars and forty-two cents ($27.42) per unit plus a twenty-five dollar ($25.00) crew charge.
      (3)   Effective the first full billing cycle after January 1, 2020:
         A.   The sum of twenty-eight dollars and thirty-eight cents ($28.38) per month, or eighty-five dollars and fourteen cents ($85.14) per quarter. However, in the event any customer requests an additional pick-up, then there shall be a charge of twenty-eight dollars and thirty-eight cents ($28.38) for each additional such pick-up.
         B.   The charge for each additional residential pick-up, as authorized under Section 959.16, shall be twenty-eight dollars and thirty-eight cents ($28.38) per unit plus a twenty-five dollar ($25.00) crew charge.
   (b)   For the purpose of this section, a multifamily dwelling means one which contains two or more separate living units. The Director shall charge to the owner of such multifamily dwelling the above-mentioned rates for each unit contained therein, which shall be paid by the owner monthly in advance of the collection service rendered.
   (c)   The following rate shall apply to any person who has qualified for and has received a homestead exemption on his or her real estate tax duplicate:
      (1)   Effective the first full billing cycle after January 1, 2019, the sum of nineteen dollars and twenty cents ($19.20) per month, or fifty-seven dollars and sixty cents ($57.60) per quarter.
      (2)   Effective the first full billing cycle after January 1, 2020, the sum of nineteen dollars and eighty-seven cents ($19.87) per month, or fifty-nine dollars and sixty-one cents ($59.61) per quarter.
   (d)   An otherwise-eligible person shall commence paying said homestead exemption rate (homestead rate) when he or she applies, in person or in writing, for said rate by presenting his or her paid real estate tax bill. Said homestead rate shall be renewed annually.
   (e)   The rates for collection services set forth in this section for residential and homestead collections are hereby authorized. The funds derived from such rates shall be paid into the Sanitation Fund of the City of Elyria.

959.115 RATES FOR COLLECTION OUTSIDE THE CITY LIMITS.
   (a)   The Director of Safety-Service shall charge, and every householder or other person accumulating garbage or rubbish, or both, shall pay, for collection services rendered for residential premises outside the limits of the City, the following rates:
      (1)   Effective the first full billing cycle after January 1, 2018:
         Monthly billing rate: $37.10
         Quarterly billing rate: $111.30
         Homestead monthly billing rate: $25.97
         Homestead quarterly billing rate: $77.91
      (2)   Effective the first full billing cycle after January 1, 2019:
         Monthly billing rate: $38.39
         Quarterly billing rate: $115.16
         Homestead monthly billing rate: $26.88
         Homestead quarterly billing rate: $80.64
      (3)   Effective the first full billing cycle after January 1, 2020:
         Monthly billing rate: $39.73
         Quarterly billing rate: $119.20
         Homestead monthly billing rate: $27.82
         Homestead quarterly billing rate: $83.45
   (b)   All provisions of Section 959.11, not in conflict herewith, shall apply to collection services outside the City limits and the accounts for same.

959.12 PAYMENT OF CHARGES.
   Each account holder shall pay the rates hereinbefore set forth. All moneys received for the collection or disposal of garbage or rubbish, shall be deposited in the Sanitation Fund and applied to the retirement and interest on notes or bonds heretofore or hereafter issued for the purchase of equipment or for the acquisition or construction of any permanent improvements to be used for, or in connection with, the collection and disposal of garbage or rubbish.

959.13 PLACEMENT AND REMOVAL OF GARBAGE; REMOVAL OF CONTAINERS.
   (a)   Garbage, rubbish, commingled recyclable materials and yard waste shall not be placed on curb lawns, or other collection sites, before 5:00 p.m. on the day before the designated pick-up day and after 7:00 a.m. on the designated pick-up day. Empty containers shall be removed from the curb lawn or other collection site within twelve hours after pick-up.
   (b)   The Director of Safety-Service may authorize additional pick-ups of garbage, rubbish and commingled recyclable materials and yard waste placed on curb lawns or other collection sites in violation of division (a) above. The charge for any additional pick-ups shall be in addition to the penalty provided in Section 959.99(b).

959.14 CLOSING OF LANDFILL FACILITIES AT CMG COMPLEX ON GARDEN STREET.
   The site of the former landfill facilities at the CMG Complex on Garden Street is hereby permanently closed as a landfill to all persons, and no dumping shall be permitted except as hereinafter provided.
