Whenever the Superintendent of the Wastewater Pollution Control Plant finds that any user has violated or continues to violate this chapter or the user's wastewater discharge permit, the Superintendent or his or her designee may serve upon said user a written notification of violation (NOV). A NOV shall state the nature of the violation and shall be served personally or by certified mail upon the authorized representative of the user. Within ten days of receipt of the NOV, the user shall submit to the Superintendent, in writing, an explanation of the violation and a plan and schedule for abatement of the violation. Submission of the plan for abatement in no way relieves the user of liability for any violations occurring before or after receipt of the NOV.
