The Civil Service Commission shall provide by rule for the determination of merit and fitness as the basis for appointment and promotion in the classified service of the City as required by the Constitution of Ohio.
All compensated positions in the service of the City shall be in the classified service, except the following, which shall comprise the unclassified service:
1. Members of the Council,
2. The Clerk of Council and other employees of the Council,
3. The Mayor,
4. The City Finance Director,
5. The Administrative Finance Counsel,
6. The City Law Director, Assistant Law Directors, or special legal counsel,
7. The Administrative Legal Counsel, Assistant Administrative Legal Counsels, or special legal counsel,
8. The Safety-Service Director and Assistant Safety-Service Directors,
9. The Director of Purchasing and Personnel,
10. Professional engineers employed by the City,
11. Members of boards and commissions established by this Charter or by ordinance of Council,
12. Volunteer members of the Division of Fire and members of the auxiliary police unit within the Division of Police,
13. The Secretary of each board and commission established by this Charter or by ordinance, provided that if such Secretary holds other employment within the classified service of the City, this section shall not exempt such person from the requirement of competitive examination to hold such other employment,
14. Persons of exceptional professional or scientific qualifications engaged as consultants,
15. Unskilled laborers as defined and authorized by the Civil Service Commission,
16. Temporary employees who are not employed for more than ninety continuous days or for more than ninety days in one year, and
17. One personal secretary to the Mayor and one deputy or clerk to the City Finance Director, the City Law Director, the Administrative Legal Counsel, the Administrative Finance Counsel, and the Safety-Service Director; provided, however, that it shall be necessary for such positions to have been created by the Council.
18. Part-time employees shall be included in the unclassified service.
