(A) General.
(1) Existing features which would add value to a residential development or to the city as a whole, such as trees, historic spots, and similar irreplaceable assets, are encouraged to be preserved in the design of the subdivision.
(2) Such existing features shall not be removed from any subdivision nor any change of grade of the land affected until approval of the preliminary plan has been granted.
(B) Water rights. All water shares, in excess of that required in § 150.151 or by city ordinance, used upon, appurtenant to, or running with any land located within a proposed subdivision shall be offered to the city first if the owner of the property decides to sell them. The city shall be given the right of first refusal to purchase those water shares at the market value existing at the time the preliminary plan is submitted for approval.
