§ 91.28 VICIOUS AND DANGEROUS DOGS.
   (A)   Vicious dogs.
      (1)   The term VICIOUS DOG, as used herein, shall include the following:
         (a)   Any dog with a propensity, tendency or disposition to attack, to cause injury or damage or otherwise endanger the safety or human beings or domestic animals;
         (b)   Any dog which inflicts injury on a human being one time without provocation that requires medical treatment;
         (c)   Any dog which attacks a domestic animal on two or more occasions without provocation, while the dog was off the owner’s property; or
         (d)   Has been previously determined to be a potentially dangerous dog by the dog control authority and the owner has received notice of such determination and such dog again aggressively bites, attacks or endangers the safety of humans or domestic animals. A dog shall not be defined as a DANGEROUS DOG if the injury, damage or threat was sustained by an individual who, at the time, was committing a willful trespass, was committing any other tort upon the property of the owner of the dog, was tormenting, abusing, or assaulting the dog, or has, in the past, been observed or reported to have tormented, abused, or assaulted the dog, or was committing or attempting to commit a crime.
      (2)   No person may own, harbor or care for a vicious dog as defined herein within the village limits.
      (3)   The keeping, maintaining, owning or harboring of a vicious dog within the village limits is hereby declared a nuisance as being against the public safety.
      (4)   Whenever a nuisance exists as defined in the foregoing section, the village may proceed by a suit in a court of competent jurisdiction to enjoin and abate the same in a manner provided by law. In any criminal prosecution, the court, in addition to any penalty imposed, may enter an order of abatement as part of the judgment in said case.

   (B)   Dangerous dogs. The following breeds or any mix of the following breeds are hereby declared to be DANGEROUS DOGS: Akita; Chow; Doberman Pinscher; English Bull Terrier; German Shepherd, including the American White Shepherd; Pit Bull breeds including, but not limited to, the American Pit Bull Terrier, American Staffordshire Terrier, and the Staffordshire Bull Terrier; Rottweiler; Wolf Hybrids; American Bandogge Mastiff; Bullmastiff; Neapolitan Mastiff; Presa Canario; Boerboel; Kyiapso; Siberian/Alaskan/Eskimo/Greenland Husky; Alaskan Malamute; Olde English Bulldogge; Catahoula; Dalmation. Dangerous dogs, if outside the owner’s residence, shall be confined in fully enclosed kennels and the owner shall have and maintain at least $100,000 in liability insurance covering any damage done by the dog. Dangerous dogs shall only be walked or exercised, on a leash adequate to control the dog, within the village limits by a person 19 years of age or older.
