(A) The applicant shall file an application for approval of the final plat with the Village Clerk within one year after approval of the preliminary plat. The final plat shall conform substantially to the preliminary plat as approved, including all the information as specified in § 161.085 below and, if desired by the applicant, it may constitute only that portion of the approved preliminary plat which he or she proposes to record and develop at that time, provided however, that the portion conforms to all requirements of these regulations. No extensions for approval of the final plat shall be considered unless a written application signed by the applicant is submitted to the Village Clerk within one year of the date of approval of the preliminary plat.
(B) The final engineering plan shall contain all engineering design specifications required for the subdivision and approved by the Village Engineer, village staff, Plan Commission or other review body.
(C) The application for a final plat approval shall include five copies of the final plat, final engineering plans and supporting documents as determined by the Village Administrator. The application shall be submitted in writing and shall be accompanied by the fee required in these regulations. The Village Clerk shall forward notice of the application to the Board of Trustees and refer the application for approval of the final plat to the Plan Commission for its review, recommendations and approval or disapproval.
(D) Upon receipt of these final plans, the Plan Commission shall refer copies of the plan and all supporting documents to the village’s planner, engineer, attorney and any agency providing required facilities that should be consulted prior to approval. All comments and recommendations shall be returned to the Plan Commission within 30 days. When applicable, the Plan Commission may require the applicant to submit written statements from county, state or other public officials as may be concerned, indicating that proposals for storm drainage, sewerage disposal and water supply meet the minimum requirements for the installation and all necessary permits from these agencies have been obtained. Within ten calendar days after receipt of comments and recommendations, the owner or subdivider shall be notified in writing by the Village Administrator of those items not in compliance with the Village Zoning Ordinance and this chapter. The final engineering plans shall not be approved until after the site has been zoned according to the uses proposed in the preliminary plan. Upon resubmittal by the applicant of the modified final plans, the village shall provide a second review letter within 15 calendar days after receipt of the modified plans. In the event further modifications are required, the village shall reply to the applicant within 15 calendar days of receipt of the resubmitted modified plans.
(E) Following review by the village staff of the final plat, the applicant shall submit 20 copies of the final plat and eight copies of the final engineering plans and supporting documents to the village administration. The Plan Commission shall approve or disapprove the application for final plat approval within 60 days from the date of filing the application or the filing by the applicant of the last item of required supporting documents, whichever date is later, unless the time is extended by mutual consent, in writing. If the Plan Commission approves, it shall fix upon the plat the certifying signatures of its Chairperson, if it disapproves, it shall set forth its reasons in its own records and provide the applicant a copy.
(F) After approval or disapproval of the final plat by the Plan Commission, it shall be submitted to the Village Board of Trustees for approval. The Village Board must take action on the final plat within 60 days, unless this time period is extended by mutual consent of the applicant and the Board of Trustees, in writing.
(G) Upon approval by the Village Board of Trustees, the village shall, within 90 days thereafter. record (or verify the recording of) the final plat of subdivision with the County Recorder at the applicant’s expense. If not recorded within this time, the approvals shall be null and void. The applicant shall furnish the Clerk with five additional copies, and an electronic version in a format approved by the village, of the final plat, final engineering plan and supporting documents. One copy and the electronic version are to be retained by the Village Clerk and the other copies are to be distributed to the Village Administrator, Building Commissioner and Supervisor of Public Works and Village Engineer.
