(A)
Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this chapter shall be guilty of an ordinance violation. Except in cases where a different penalty is prescribed by any ordinance of the village (in which event the greater amount shall control), any person found to have violated this chapter to the maximum extent permitted by law shall be punished by a fine of four times the cost of the actual building permit fee or for multiply offenses, fines will be ten times the permit fee to the maximum extent permitted by law. Notwithstanding any penalties herein stated, the village may in addition revoke or suspend any permit or license previously granted to any applicant.
(B) Any person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the village is committed, continued or permitted by any such person, and he shall be punished accordingly.
(C) In all cases where the same offense is made punishable or is created by different clauses or sections of an ordinance, the prosecuting officer may elect under which to proceed; but not more than one recovery shall be had against the same person for the same offense; provided that the suspension or revocation of a license or permit shall not be considered a recovery or penalty so as to bar any other penalty being enforced.
(D) The levy and/or payment of any penalty or fine provided in this code shall not be deemed a waiver of the power of the Village of Elwood to suspend, revoke or refuse to renew any license or permit for cause. In the event that the village determines that the owner or occupant of any premises is in violation of any provision of this or any other village ordinance, the village shall have the right to discontinue any service provided to said applicant until said violation is abated to the complete satisfaction of the village.
(E) In addition to any other penalties provided in this chapter, the Village Attorney shall have the authority to seek injunctive or other relief in the Circuit Court of Will County to enforce and compel compliance with the ordinances of the village. Such injunctive action may be combined with counts seeking monetary fines as provided herein.
