§ 160.09 WATER AND SEWER TAP-ON FEES.
    Any person or entity, prior to making any connection to the village water and sanitary sewage systems of the Village of Elwood, shall upon proper application to the Village Clerk, or other person from time to time designated by the corporate authorities, shall pay the village a service charge for each separate connection to the village water and sewer utility system a fee in the amount set forth below for the purposes of providing a reasonable contribution toward the overall cost of the existing village water and sewer system (not including the cost of the area line installations to be recouped under a frontage fee as described hereafter). All service lines, water taps, materials, labor or equipment to the water and sewer service shall be supplied by the permit holder or contractor. Each connection and installation shall be made under the supervision and inspection of the Village Engineer. Upon completion of installation, all property must be placed back to its original condition prior to said installation at the sole cost of said permit holder.
   (A)   Water connection fee. For each water connection made to a residential building, structure or use, the basic connection charge hereunder shall be determined on a population equivalent (P.E.) multiplied by the respective set fee unit/building charge set forth in division (B) hereunder. Subsequent residential connections to any type of residential structure or building shall be charged a fee of $1,271 per unit. For each water connection made to a nonresidential building, structure or use, the basic connection charge hereunder shall be determined on a room, seat, or square foot gross floor area as described in division (B) hereunder.

   (D)   Water service frontage fee. In addition to the above stated connection fees, there shall be a frontage fee of $28 per frontage foot of the premises to be served charged to all applicants, except no frontage fee shall be charged to any respective owner or developer for property owned or developed by the owner or developer fronting any water main extension installed by such owner or developer and transferred to the village. All such fees shall be due and payable to the village at the time of application. The property frontage for determining this fee shall be based upon the actual frontage of a recorded, subdivided lot for each connection, except in the case of unusual lot shapes and frontage lengths that are not within (plus 50%) the minimum lot width with respect to the applicable zoning district. In the case of unusual lot shapes or frontage lengths, the Village Engineer will determine frontage length based upon reasonable engineering guidelines and consideration of the zoning district and potential subdivision of the land. Some methods of calculation may include but shall not be limited to the calculation of lot frontage at the building setback line or the averaging of front and rear lot lines.
   (E)   Sewer connection fee. For each sewer connection made to a residential or nonresidential building structure or use, the basic connection charge hereunder shall be determined by the sewer connection fee schedule set forth in division (F) hereunder. Subsequent connections to any type of residential building, structure or use, shall be charged a fee of $1,000 per unit.

   (H)   Sewer service frontage fee. In addition to the sewer connection fees described in division (F), there shall be a frontage fee of $46 per frontage foot of the premises to be served charged to all applicants, except no frontage fee shall be charged to any owner or developer for property owned or developed by the respective owner or developer fronting any sewer line extension installed by such owner or developer and transferred to the village. All such fees shall be paid by applicant at the time of application.
