(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
(B) Every person, firm, corporation, association or organization who violates any provision of § 153.02 shall be fined from $25 to $500 per day and each day the violation continues shall constitute a separate offense. The village will have the premises cleaned or cleared at the rate of $80 per hour which shall be added to the municipal utility bill of the owners, occupants, operators or agents as may be appropriate.
(C) Whoever violates any of the provisions of § 153.04, including failure to submit a foundation survey, resuming any construction activity prior to receipt of an approved foundation survey, failure to retain an approved copy of the foundation survey at the construction site, failure to secure a building permit, or failure to have proper inspections will subject the applicant of the building permit to fines not less than $50 nor more than $500 for each offense, and a separate offense shall be deemed committed on each day during and on which a violation occurs or continues.
(D) (1) Any person who violates any provision of the Fire Prevention Ordinance (§§ 153.20 through 153.24) or who fails to comply with any of the requirements hereof shall be subject to a fine of $100 in the case of a first violation, and a fine of $500 for each and every subsequent violation. Each day that a violation continues shall be deemed a separate violation.
(2) The application of the above penalty shall not prevent the enforced removal of prohibited conditions.
(3) Injunctive relief: as an alternative or in conjunction with the imposition of a fine as provided in division (D)(1) above, the district may elect to seek injunctive relief from a court of equity requiring compliance with the code, demolition of the offending structure or removal of the offending condition. The district shall be entitled to an award of reasonable attorneys’ fees and all costs of litigation including court costs, deposition fees and expert witness fees incurred in enforcing this §§ 153.20 through 153.24 through this provision.
