15-15A-3: APPLICATION OF POLICIES:
   A.   Applicability: This chapter applies to all of the following landscape projects:
      1.   New development projects with an aggregate landscape area equal to or greater than five hundred (500) square feet requiring a building permit, plumbing permit, or design review.
      2.   Rehabilitated landscape projects with an aggregate landscape area equal to or greater than two thousand five hundred (2,500) square feet requiring a building permit, plumbing permit, or design review.
      3.   Projects with an aggregate landscape area of two thousand five hundred (2,500) square feet or less may comply with the performance requirements of this chapter or conform to the prescriptive measures contained in section 15-15A-13 of this chapter.
      4.   Projects using treated or untreated gray water or rainwater captured on the site, with an area less than two thousand five hundred (2,500) square feet which meets the lot or parcel's landscape water requirement (estimated total water use) entirely with treated or untreated gray water or through stored rainwater captured on the site. Projects using gray water systems must conform to the California plumbing code (California code of regulations title 24, part 5, chapter 16).
      5.   Cemeteries. Recognizing the special landscape management needs of cemeteries, new and rehabilitated cemeteries are limited to section 15-15A-6 and subsections 15-15A-5I and 15-15A-14D of this chapter; and existing cemeteries are limited to the requirements described in section 15-15A-15 of this chapter.
      6.   Existing landscapes limited to the requirements described in section 15-15A-15 of this chapter.
   B.   Nonapplicability: This chapter is not applicable to:
      1.   Registered local, state or federal historical sites.
      2.   Ecological restoration projects that do not require a permanent irrigation system.
      3.   Mined land reclamation projects that do not require a permanent irrigation system.
      4.   Existing plant collections, as part of botanical gardens and arboretums open to the public.
      5.   Any project with a landscaped area less than five hundred (500) square feet, unless the Director of Community Development determines that substantial compliance with the purpose of this chapter requires that a landscape plan be submitted or the existing irrigation system must be modified.
