1331.99 PENALTY.
   (a)   Whoever, being able to do so, neglects or refuses to obey a proper order issued by the Village Superintendent or his duly authorized representative, pursuant to this chapter, is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day that such unlawful condition is permitted to exist after the time specified for the abatement thereof by the owner or occupant in any notice provided for herein. No prosecution under this section shall be maintained unless the Zoning Inspector, Fire Chief and Village Superintendent unanimously find that an unlawful condition, as defined in this chapter, exists and should be abated, nor in cases where the concurrence of the Ottawa County Health Department is required by Section 1331.03, unless such Health Department also concurs.
   (b)   Whoever fails to comply with any of the provisions of this chapter for which no penalty is otherwise provided is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00). (Ord. 014-95. Passed 7-24-95.)
