1420.04   AMENDMENTS.
   The BOCA National Building Code, as adopted in Section 1420.01, is hereby amended as follows:
   Whenever the words “name of jurisdiction” appear in brackets in the Code, the words “Ellwood City Borough” shall be inserted in place of those bracketed words. Likewise, the words “Ellwood City Borough” shall be substituted for the word “jurisdiction” where it appears singly in the Code without being followed by the words “under the.”
   The term “chief appointing authority of the jurisdiction” and the term “chief authority of the jurisdiction,” as used in the Code, shall mean the Council of the Borough of Ellwood City.
   The term “legal officer of the jurisdiction,” as used in the Code, shall mean the Borough Solicitor.
   Whenever the term “code official” is used in the Code, it shall mean the Building Inspector.
   101.1    Title: (Amended) These regulations shall be known as the Building Code of the Borough of Ellwood City, Pennsylvania, hereinafter referred to as “the code,” or “this code.”
   104.3    Organization: (Deleted)
   104.4    Deputy: (Deleted)
   105.4    Inspections: (Amended) The code official shall make all of the required inspections or reports and shall accept reports of other authorized agencies or individuals as authorized by Council.
   107.5    Documents: (Amended) The application for permits shall be accompanied by a set of construction documents, or by two sets, if deemed necessary by the code official. The code official may waive the filing of such documents when the scope of work is of a minor nature. When quality material is essential to conform to this code, specific information shall be given, and this code shall not be cited or the term “legal” or its equivalent used to substitute for specific information.
   108.5    Approved document: (Amended) The code official shall endorse the formal application “Approved” (or “Disapproved”) and file such form in the records of the code official's office.
   112.3.1    Fee schedule: (Amended) A fee for each plan examination, building permit and inspection shall be paid in accordance with a fee schedule resolution as approved by Council from time to time.
   114.1    Professional services: (Amended) Construction documents for new construction, alterations, repairs, expansion, additions or modifications for buildings or structures shall be prepared by a registered engineer or an architect registered as per the Commonwealth of Pennsylvania laws. The documents shall include such registered engineer or architect's name and address and shall be signed and sealed consistent with the Commonwealth of Pennsylvania laws. Such requirement may be waived by the building official when deemed unnecessary by the code official.
   116.4 Violation penalties: (Amended) Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure, or any part thereof, in violation of a detailed statement or plan submitted under this code, an approved plan or directive of the code official or a permit or certificate issued under the provisions of this code, shall be guilty of a summary offense, punishable as provided in Section 202.99(a) of the Administration Code of the Codified Ordinances of Ellwood City.
   118.4 Contents of certificate: (Amended) When a structure is entitled thereto, the code official shall issue a certificate of occupancy within ten days after written application therefor. Upon completion of the final inspection in accordance with Section 113.3 and correction of the violations and discrepancies, the certificate of occupancy shall be issued.
   3301.0 General: (Amended) The provisions of this chapter are intended to maintain or increase the current degree of public safety, health and general welfare in existing buildings while permitting repair of, addition to and/or change of use of, such buildings. Such repairs, additions or changes of use shall not require full compliance with Chapters 1 through 35 of and when the code official, with the approval of Council, determines to waive any of such requirements.

SPECIAL MISCELLANEOUS PROVISIONS (Added)
   SECTION 3601.0 DEVELOPMENT SITE PLAN
   3601.1 Information required: The following information and items shall be furnished and placed upon the site plan and attached to an application for a permit for the development of land to be used for multiple residential units and commercial, industrial and off-street parking facilities. Applications for permits cannot be processed until the site plan with all of the required information is reviewed and approved by the appropriate Borough departments and officials.
   1.   The plan drawn to scale and prepared by a registered professional engineer or surveyor.
   2.   The existing and finished elevations (contours) of the entire site and 10 feet into the adjoining properties affected by the proposed improvements, and along the property lines between said properties.
   3.   Location, size and use of all existing structures, those to be razed and proposed new structures and distances from the front, side and rear property lines.
   4.   Locations, dimensions and existing and finished elevations of all off-street parking and loading areas, including layout, size and number of parking/ loading spaces, the type of screening to be installed, as and where required by Borough regulations, and the type of surface to be placed on off-street parking areas (including a brief description of surface materials).
   5.   Locations of driveways, size and elevations between parking areas and streets at gutter lines of curbs and at center of cartways. Cross sections of driveways at the centerline may also be submitted.
   6.   Elevations of existing sidewalks and curbs fronting or abutting the proposed improvement site and any proposed changes.
   7.   Location, type and height of existing trees which are 10 inches or more in diameter that are proposed and required to be removed and the location, type and size of any new trees to be planted as part of the site improvements. Proposed landscaping may also be shown if possible or on a separate plan.
   8.   Location of all utilities, water, gas, electric, television cable, sanitary and storm sewer facilities and of connections from the improvement site to such utilities. Connections for electricity shall be approved by the Borough's Electric Department; connections for water shall be approved by the PAWC; connections for gas shall be approved by Columbia Gas Company, etc.
   9.   For connection to the Borough's sanitary sewer system, information on the number of gallons of sanitary sewerage to be discharged from the improvement site into the system calculated by the applicant and to be reviewed and approved by the Borough Wastewater Treatment Department prior to approval and issuance of the permit.
   10.   For connection to the Borough's storm sewer, information on the amount of water to be collected from off the site, including roof drains, paved areas and similar areas, calculated by the applicant and to be reviewed and approved by the Borough Engineer prior to approval of the permit.
   11.   If no storm sewer facilities are available or cannot be used, information and plans, prepared by a registered engineer, on the manner in which all storm water run-off will be collected and disposed of. On-site storm water retention systems must be submitted for review and approval by the Borough Engineer prior to approval of the permit.
   12.   Three copies of the required site plan and supporting information, as required by the regulations, submitted with and as part of the application for a permit for review and approval by the Building Inspector, the Zoning Officer and other appropriate Borough officials, prior to approval of the application and issuance of a permit.
   SECTION 3602.0 FILLING, GRADING AND DRAINAGE
   3602.1 Permits: When determined necessary by the Building Inspector, no building permit shall be issued until a grading permit is approved and issued. When the application for a building permit is submitted, the applicant shall show in detail any proposed cuts, fills, changes of grade, change of existing watercourses, drains or ditches, off-street parking areas and the type of surface thereof, and any proposed changes in the same. No permit shall be issued if the cut, fill, change of grade, change of watercourse, drain or ditch drainage, or change of off-street parking areas and driveways, will cause a dangerous or unhealthy condition, or adversely affect other properties or public rights of way, or create a public or private nuisance. French drains, downspouts and any springs and storm water must be drained to an existing storm watercourse and/or an approved type of retention facility. Water shall not be drained in or on the road or street.
   3602.2 Width of grading: All lots shall be graded in such a manner so as not to interfere with the grade or contour of the street right of way. A minimum of 5 feet above a shoulder, with a slope not in excess of 5 percent, shall be maintained behind the line of the curb or any road, unless the right of way has been graded to a greater width, in which case the graded width shall be maintained.
   Provided: This section shall not be applicable to conditions and/or requirements of the Zoning Code and/or the Subdivision Regulations and Land Development of the Borough of Ellwood City.
