1244.10   MODIFICATION.
   (a)   The Council may grant a modification of the requirements of one or more provisions of these Subdivision and Land Development Regulations if the literal enforcement will exact undue hardship because of peculiar conditions pertaining to the land in question, provided that such modification will not be contrary to the public interest and that the purpose and intent of these Regulations are observed.
   (b)   The following process must be observed:
      (1)   All requests for modification shall be in writing and shall accompany and be part of the application for development. The request shall state, in full, the grounds and facts of unreasonableness or hardship on which the request is based, the provision or provisions of these Regulations involved and the minimum modification necessary.
      (2)   The request for modification shall be referred to the Borough Planning Commission for review and recommendation.
      (3)   The Council and the Borough Planning Commission shall keep a written record of all actions taken on all requests for modifications.
      (4)   If modifications are granted, a notation regarding the modifications granted, including the date of the Council action, shall be placed on the final plat to be recorded in the office of the County Recorder of Deeds.
