1070.04   FALSE ALARMS.
   (a)   No person shall cause a false alarm, intentionally or unintentionally or due to a malfunction of the alarm system.
   (b)   Any person(s) involved in false alarms which are monitored by the Borough and does not respond to the scene, shall pay a fee to the Borough for costs involved as follows:
      (1)   If there is no response to the scene by the person(s) whose alarm intentionally or unintentionally is set off, than such person(s) shall pay the following fees plus cost of prosecution (civil or criminal), per calendar year:
         A.   First occurrence   $25.00
         B.   Second occurrence   $30.00
         C.   Third occurrence   $75.00
         D.   Fourth occurrence and thereafter   $100.00
   (c)   If a person(s) whose alarm sounds responds to the scene, there shall be no fee per calendar year for the first three occurrences. For each subsequent occurrence in that calendar year up to and including five occurrences there shall be a fee of twenty-five dollars ($25.00) plus cost of prosecution (civil or criminal). For the sixth occurrence, there shall be a fifty dollar ($50.00) fee plus cost of prosecution (civil or criminal). For seven or more occurrences there shall be a one hundred dollar ($100.00) fee plus cost of prosecution (civil or criminal).
      (1)   For the first three occurrences per calendar year: no fee; and
      (2)   For each subsequent occurrence per calendar year: $15.00, plus costs of prosecution.
