1060.06   LICENSING OF HAULERS.
   (a)   No person shall collect or remove garbage, rubbish or refuse from properties within the Borough, or haul, transport or convey garbage, rubbish or refuse through or upon any of the streets or alleys of the Borough, except as provided in this section.
   (b)   Any person who may wish to engage in the business of collecting, hauling and disposing of garbage, rubbish and refuse in the Borough shall, prior to engaging in such business, make application for and obtain a solid waste license from the Borough. Any person desiring such a license shall have the following qualifications:
      (1)   He or she shall own or have properly leased equipment to be used for the collection and hauling of garbage, rubbish and any refuse materials to be collected. The equipment must have a steel body with steel covers and be leak proof.
      (2)   He or she shall own, lease or have authorization to use a disposal facility in accordance with all present and future laws of the Commonwealth; the rules, regulations, standards and procedures that may be established by the Commonwealth's departments and agencies; any present and future Federal laws; and any other ordinances of the Borough and other municipal subdivisions of the Commonwealth through which or in which the business of collecting, hauling and disposing of refuse from the Borough may take place.
      (3)   He or she shall maintain an office or other facility which shall be equipped with a telephone through which the contractor can be contacted.
   (c)   Applicants for a solid waste license shall furnish the following information:
      (1)   The number of vehicles to be used for collection and hauling in the Borough and the make, model, license plate number and size of the packer body of each such vehicle.
      (2)   Certification of the owner or authorization to use a disposal facility, as required by Borough ordinance.
      (3)   A certificate of insurance coverage carried by the collector, such as liability, third-party comprehensive, etc.
      (4)   All other information which the Borough may deem necessary and request from time to time prior to the issuance of a license.
   (d)   Applications for a solid waste license must be submitted annually to the Secretary/Treasurer. All applications shall be reviewed by the Health Officer prior to issuance by the Secretary/Treasurer. Each license shall be granted for one year or such portion of a calendar year as may then be remaining. The fee to be charged shall be based on such portion of such year. All licenses so issued shall expire on December 31 of each calendar year. Licenses may be revoked by the Borough for the failure of a licensee to provide collection and disposal service in accordance with this chapter. A written notice shall be given to a licensee prior to the date the license is to be revoked, and such notice shall state in full the reasons such action is being taken.
