1022.08   AUTHORITY FOR PROPERTY OWNERS TO DO WORK ON OWN INITIATIVE.
   (a)   Any property owner, upon his or her own initiative and without notice from any Borough authority, may construct, reconstruct or repair a sidewalk in front of or along his or her property, provided that he or she shall first make application to the Borough and shall conform to the requirements of this chapter and the specifications adopted hereunder as to line and grade, materials used and manner of constructing, reconstructing or repairing such sidewalk, and provided, further, that he or she shall also notify the Engineer as required by Section 1022.07 within two days after completion of the work.
   (b)   Any owner of property that is zoned as commercial or industrial and that has never had sidewalks installed, or that is not required to construct a sidewalk by action of Council, upon his or her own initiative and without notice from any Borough authority, may construct a sidewalk of approved bituminous concrete material in front of or along said property, provided that he or she shall first make application to the Manager and shall conform to the requirements of this chapter and the specifications adopted hereunder as to line and grade, materials used and manner of construction, and that he or she shall notify the Borough within two days after completion of the work.
