Failure of the food service establishment to provide, in the time frames described, the subsequent required documentation and adoption of the best management practices will result in a violation of this chapter. This violation will result in an immediate Notice of Violation. The Notice of Violation shall carry an automatic fine of one hundred dollars ($100.00) and provide the food service establishment with ten calendar days from the date the Notice was issued to correct the problem. Any person who shall fail, neglect or refuse to comply with any of the terms or provisions of this chapter, or of any regulation or requirement pursuant thereto and authorized thereby shall, upon conviction before any district justice, be sentenced to pay a fine of one thousand dollars ($1,000) and costs of prosecution, and in default of payment thereof, to imprisonment for a term not to exceed ninety days.
