(a) In General. No person shall keep, within the limits of the Borough, any pigeons other than homing pigeons.
(b) Keeping of Homing Pigeons. No homing pigeons shall be kept within the limits of the Borough, except in compliance with the following requirements and regulations:
(1) Such pigeons shall be confined in a loft and aviary of a design and construction approved by a recognized national or State pigeon association, which loft and aviary shall be kept dry, well ventilated and with windows so placed as to admit sunlight; kept whitewashed or painted within; cleaned at least once a week, from October through March, and twice a week, from April through September, of each year; and located no closer than thirty feet away from any living quarters other than the owner's residence.
(2) A permit to maintain any such loft and aviary shall be issued by the Health Officer to any applicant, only upon the applicant's written request. An annual fee of five dollars ($5.00) shall be paid for a permit.
(3) Homing pigeons may be permitted to fly at large at the discretion of their owners, provided that such flights are liberated away from the loft or aviary and that such pigeons, upon returning from the flight, shall immediately enter the loft or aviary upon completion of such flight. No pigeons shall be permitted to perch on any property other than the owner's loft or aviary.
(4) Every such homing pigeon shall have, upon its leg, a numbered band identifying the owner.
