420.03   USE OF EXCESSIVE SPEED PREVENTOR EQUIPMENT.
   (a)   Findings; Purpose. The Borough has determined by its action that the use of the Excessive Speed Preventor (E.S.P), Model TK100, or any other device, either mechanical, electrical or electronic (radar), or of any combination of the above devices, is permissible as long as such devices are hereafter approved for use by the Pennsylvania Department of Transportation for enforcement of speeding and/or traffic enforcement by municipal police departments. The primary purpose for these devices and their use is to promote or facilitate the health, safety, morals and/or general welfare of the citizens and residents of the Borough and the general public overall.
   (b)   Use by Police Department. The use of the aforesaid devices by the Police Department, under the direction of the Mayor, on all streets or highways within its jurisdiction, is hereby authorized.
   (c)   Conditions of Use. Authorization for the use of approved devices for enforcement of the Vehicle Code by the Police Department is hereby granted as follows:
      (1)   Any device used must first be approved for use by the Pennsylvania Department of Transportation.
      (2)   When the device is used, it shall be used in accordance with any guidelines or requirements set by the manufacturer or the Pennsylvania Department of Transportation for its use.
   (d)   Excessive Speed Preventor. As used in this section, the term "Excessive Speed Preventor (E.S.P.)" shall include E.S.P., Model TK100, and all future models of this device or similar devices, either electrical, mechanical or electronic, the intended purpose of which is to determine the speeds of vehicles.
