(a) Adoption of Policy and Procedure. The following Borough policy and procedure shall be followed for granting written consent for the installation of signs, banners or advertising matter over streets, alleys or highways in the Borough.
(b) Consent of Council Required. No person shall place any sign, banner or advertising matter of any kind whatsoever on or across any street, alley or highway in the Borough, or on or across any structure within the legal limits of any Borough street, alley or highway, without first having obtained the consent of Council therefor. Such consent shall be given only by a resolution of Council.
(c) Conditions for Granting Requests. Requests for installation of the devices provided for in subsection (b) hereof will be given consideration only if:
(1) The request is made by letter from the responsible party.
(2) The message on the sign or banner relates to a national, State, regional or local function or charitable affair and not more than 20% of the message on the sign or banner relates to naming and/or advertising a commercial project, enterprise, business or company that is sponsoring the event and/or the banner installation.
(d) Information on Requests. The official request shall contain the following information:
(1) A description of the device to be used (sign, banner, etc.), including the size of the device (length and width), any message on the device and the vertical clearance from the pavement to the lowest part of the device.
(2) The location where the device is to be erected.
(3) The approximate date of installation and removal of the device.
(4) A statement that the requesting party assumes full responsibility for erecting, maintaining and removing the device and for any liability that might result therefrom.
(e) Obtaining Request Forms. Requests forms must be obtained at the office of the Borough Secretary 45 days prior to the date of installation.
(f) Declaration of Nuisance. Any such sign, banner or advertising matter, as provided for in this section, which are placed without the consent of the Borough shall be declared to be a public nuisance and may be abated by the Borough with or without notice to the person responsible for the placing of such sign, banner or advertising matter.
(g) Exceptions. Council does hereby except from this section a certain sign located on Fifth Street, approximately 20 feet south of its intersection with Lawrence Avenue, which sign now displays the name of the Borough, and any sign which may hereafter replace the aforesaid sign, if it is approved by Council.
(h) Placement Across State Highways or Roads. Persons wishing to place a sign or banner across State highways or roads must comply with Section 211.10 of Title 67, Pa. Code, as amended.
