(a) Registration. Upon adoption of this chapter, and during January each year thereafter, every business and/or person within the Borough owning a sign shall register the sign with the Building Inspector in order to receive certification of compliance (a sign license).
(1) Every sign owner will be required to pay a licensing fee for each sign of ownership;
(2) At the time of licensing, all projecting signs which protrude over the public right of way and all free-standing signs that are and have been erected within 20 feet from the public right will be required to carry liability insurance and receive a certificate of compliance.
(3) The sign owner will have fifteen days from receipt of notice to provide proof of such insurance to the Building Inspector.
(4) It is also required for the sign owner to sign the liability form which stipulates proof of said liability insurance on an annual basis. Such form shall be provided by the Building Inspector.
(5) It will be the responsibility of the Building Inspector to annually inspect all signs within the Borough and to record proof of liability of designated signs.
(6) Licensing and certification fees will be established from time to time by resolution of Council.
(b) Example of Liability Insurance Form.
I, the undersigned, on this _____ day of _____________, 20___, hereby agree to provide liability insurance in the amount of $__________for the sign located at ___________, Ellwood City, PA. The insurance policy will state that the Borough will not be held legally responsible for any damage done to any persons or property. I understand that it is my responsibility to provide a record of the insurance to the Building Inspector on an annual basis.
