§ 93.01  DISEASE CONTROL.
   (A)   No person within the corporate limits of the town shall institute, permit, or maintain any conditions whatever that may transmit, generate, or promote disease.
   (B)   The Director of Planning Services shall be the Town Health Officer, who upon verification of this type of unlawful conditions within the corporate limits of the town, shall, in writing and by posting a written notice of violation, order their abatement, specifying particularly wherein the condition may transmit disease and naming the shortest reasonable time for abatement. The longest reasonable time for abatement may not exceed must ten days.
   (C)   Any person who refuses to comply with the written notice from authorized personnel commits a Class D ordinance violation, and a judgement may be entered against the violator.
   (D)   The town may also institute proceedings through the Town Attorney in the courts of the county for enforcement of the orders of the Town Health Officer. These orders may be enforced by whatever legal remedy available to the town including prohibitory or mandatory injunction.
   (E)   The Health Officer, Deputy Health Officer(s), the Town Marshal, and Deputy Marshals are hereby authorized to issue citations for violations of this chapter.
