§ 51.50  DECLARATION OF EMERGENCY.
   (A)   In the event of fire, flood, drought or other emergency, and upon being notified by the Town Water Company's superintendent that the town's water system is in a condition of water shortage, the Town Council may declare the existence of a water emergency, whereupon the respective water conservation measures described below in § 51.51 shall apply until the water emergency is terminated.  Notice of the emergency shall be provided by publication in the Bloomington Herald Times and the Ellettsville Journal.  Notice of the declaration of a water emergency shall be deemed effective upon publication.  After notice has been given, it shall be unlawful to use water for any and all purposes specified in § 51.51.  Whenever the Town Council finds that some or all of the conditions that gave rise to the declaration of a water emergency no longer exists, the Town Council may declare the water emergency terminated.
   (B)   In the event of an immediate emergency, such as a large diameter main break, the presiding Town Council President may, upon recommendation of the Town Water Company's superintendent, declare the existence of a water emergency, whereupon the respective water conservation measures described in § 51.51 shall apply.  Notice of the emergency shall be provided by announcement on at least one local radio station and by the Town Clerk Treasurer posting notice of the declaration of emergency at all town owned buildings. After notice has been given, it shall be unlawful to use water for any and all purposes specified in § 51.51.  Publication of the declaration of emergency shall thereafter be provided to both the Bloomington Herald Times and the Ellettsville Journal as soon as possible thereafter. Once the presiding Town Council President has declared a water emergency, the Town Council shall, at its next scheduled meeting, consider the Town Council President's declaration of emergency and the conditions that gave rise to the declaration. The Town Council may then either extend or terminate the water emergency declaration.
