This chapter shall apply to all landowners, permit holders, developers, other entities in possession, or other persons acting without the consent of a landowner which affects any real estate located within the Town of Ellettsville which either:
(A) Directly discharges into a regulated drain established by the Town of Ellettsville, pursuant to I.C. 36-9-27;
(B) Directly discharges into a street drain located within the town;
(C) Directly discharges into Jack's Defeat Creek or McCormick's Creek; and
(D) Is included in the MS4 jurisdiction as defined in the Notice of Intent unless covered by another MS4 illicit discharge and elimination ordinance.
