ORDINANCE NO. 292

AN ORDINANCE AMENDING CITY OF ELKO NEW MARKET CITY CODE TITLE 8, CHAPTER 2, CONCERNING CITY PARKS

THE CITY COUNCIL OF THE CITY OF ELKO NEW MARKET, MINNESOTA ORDAINS:

SECTION 1. Section 8-2-1 of the Elko New Market City Code is hereby to delete the definition of 3.2% Malt Liquor.

SECTION 2.   Section 8-2-1 of the Elko New Market City Code is hereby amended to add the following definition:

MALT LIQUOR: Any beverage made from malt by fermentation, or by the fermentation of malt substitutes, including rice, grain of any kind, glucose, sugar, molasses, or other malt substitute that has not undergone distillation, and that contains not less than one-half of one percent alcohol by volume.

SECTION 3.   Section 8-2-5 of the Elko New Market City Code is hereby amended to read as follows:

8-2-5: ALCOHOLIC BEVERAGES AND GLASS CONTAINERS:

The consumption and possession of alcoholic beverages in city parks is subject to the following provisions:

   A.   Consumption And Possession Of Alcoholic Beverages: The consumption and possession of intoxicating liquor, except for wine and malt liquor, is prohibited in city owned parks.

   B.   Glass Containers Prohibited: Glass beverage containers are prohibited in city owned parks.

   C. Kegs: Kegs and barrels used as containers for malt liquor are prohibited in city owned parks.

SECTION 4.   Section 8-2-9(D) of the Elko New Market City Code is hereby amended to read as follows:

D.   Gambling in any city park is prohibited. There shall be an exception for gambling at community events with approval by the city council.

SECTION 5.   This Ordinance shall take effect immediately upon its passage and publication.

   ADOPTED this 11th day of April, 2024, by the City Council for the City of Elko New Market.
