5-1A-10: COLLECTION REGULATIONS:
Licensed mixed municipal solid waste collectors shall comply with the following collection regulations. Failure to observe these provisions may be a basis for suspension or revocation of a license.
   A.   Duty To Collect; Number Of Collections: It shall be the duty of each licensed mixed municipal solid waste collector to haul away once each week to such places as designated in the license application all mixed municipal solid waste from premises located within the area in which he is authorized to collect mixed municipal solid waste.
   B.   Vehicle Requirements: Each licensed mixed municipal solid waste or recyclable material collector shall use collection trucks that are properly licensed and inspected by the state. The trucks shall be kept clean and as free from offensive odors as possible, and shall not be allowed to stand in any street, alley, or public place longer than is reasonably necessary to collect mixed municipal solid waste and recyclable material.    C.   Days And Hours Of Collection 1 : No collections of mixed municipal solid waste or recyclable material shall be made except between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M., Wednesday and Friday. Operations during these hours may also be conducted on Thursday to accommodate recognized national holidays or a "special pick up" as defined in section 5-1-1 of this chapter. Pick ups on Saturdays may occur only when a recognized national holiday occurs on a Friday. Customers shall be reasonably notified of the specific day and hours of the collection of their mixed municipal solid waste and/or recyclables, and the licensee shall collect the materials within those time periods.    D.   Refusal To Collect: The collector may refuse to make collections from any premises when the fees are not paid within one month from the date such mixed municipal solid waste or recyclable material is collected. The collector shall notify the city clerk of the discontinuance of service to any premises within one week after service is discontinued. (Ord. 12, 10-11-2007, eff. 1-1-2008)
   E.   Collecting Recyclable Materials Required: It shall be the duty of each licensed mixed municipal solid waste collector to haul away bimonthly, on the same day as mixed municipal solid waste service, to such places as designated in their license application, the targeted recyclable materials from residences with individual curbside mixed municipal solid waste containers within the area in which they are authorized to collect mixed municipal solid waste and recyclable material. Each licensed mixed municipal solid waste and recyclable material collector shall do the same from residences of those who occupy multiple-family (apartment) dwellings. The costs of collecting recyclable material shall be included in the general pricing scheme for collection of mixed municipal solid waste and recyclable material. (Ord. 84, 12-1-2011)
   F.   Recyclable Material Report: It shall be the duty of each licensed mixed municipal solid waste and recyclable material collector and nonprofit organization collecting recyclable material to provide the city with an annual report from the previous year on quantity and type of all material recycled within the city. The city reserves the right to request a copy of weight slips obtained from each recyclable purchaser or other documentation satisfactory to the city verifying that the collector is delivering recyclable materials to a state approved recycling facility. Failure to provide the foregoing documentation may be cause for revocation of the license. (Ord. 115, 11-20-2014)
   G.   Necessary City Approval To Landfill Or Incinerate Recyclables: It shall be unlawful for any person engaged in the business of collecting recyclable material to landfill or incinerate collected recyclable material without approval from the city.
   H.   Yard Waste:
      1.   Christmas Tree Collection: Each collector shall pick up Christmas trees at no cost to the city or its residents in January and shall work with the city to notify residents of the specific date(s) for collection. (Ord. 12, 10-11-2007, eff. 1-1-2008)
      2.   Yard Waste Pick Up:
         a.   Regular: Each collector will collect leaves on two (2) dates (1 in the spring and 1 in the fall on dates agreed upon with city) at no cost to the city or the collector's customers and will work with the city to notify residents of the specific date(s) for collection. These dates shall coincide with the city's annual recycling days. Yard waste must be placed in paper compostable bags or bundled as brush and shall be limited to a combination of six (6) bags or bundles. (Ord. 84, 12-1-2011)
         b.   Special: Each collector may provide additional yard waste pick ups and will be responsible for billing residents directly and collecting all service charges and fees for additional yard waste pick ups.
      3.   Manner Of Collection: Each collector shall segregate yard waste materials from other solid waste materials. Collectors shall not mix other types of waste or refuse or inorganic materials with the yard waste or take any action so as to make the yard waste unacceptable at a compost facility satisfactory to the city.
      4.   Disposal: Each collector shall weigh, transport, and dispose of each load of material. Disposal of the material shall be to a licensed facility approved by the city for composting.
   I.   Changes In License Information; Notice To City: The licensee shall operate in a manner consistent with its application materials and shall provide notice to the city within ten (10) days of any changes in information, forms or certificates filed as a part of the license application process, except for the thirty (30) day notice required by subsection 5-1A-5E of this article.    J.   Minimum Service; Rate Structure: Residential mixed municipal solid waste and recyclable material collector rates shall include a minimum of three (3) levels of regular service, priced on the basis of volume, with a rate structure designed to encourage reduction, reusage, and recycling. The rate structure shall increase with the volume of the waste collected. Residential mixed municipal solid waste and recyclable material collectors are prohibited from imposing a greater charge on residents who recycle than on residents who do not recycle. Upon request of the city, the licensee shall produce a copy of the collection rate structure. (Ord. 115, 11-20-2014)

   L.   Compliance With Laws: The licensee shall comply with all state, county, and local laws and regulations. (Ord. 12, 10-11-2007, eff. 1-1-2008)
