§ 92.999 PENALTY.

   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.

   (B)   Any person who shall violate the provisions of § 92.002 shall, upon conviction, be fined an amount set forth by Council from time to time for each offense.

   (C)   Any person violating any provision of § 92.004 shall be guilty of a misdemeanor and shall be subject to a fine of an amount set forth by Council from time to time. Each day that a violation continues to exist without correction, shall constitute a separate offense.

   (D)   (1)   Any person or corporation, or responsible officer of the corporation, who violates any of the provisions of the Fire Prevention Code, adopted under §§ 92.015 through 92.021, shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined an amount set forth by Council from time to time or imprisoned not more than 30 days, or both fined and imprisoned.

      (2)   Each and every day during which any illegal erections, construction, reconstruction, alteration, maintenance or use continues after knowledge or official notice that the same is illegal shall be deemed a separate offense.

      (3)   The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions, where applicable.

   (E)   Any property or building owner failing to comply with, or in violation of, the terms of § 92.041 after notice from the Fire Chief, shall be subject to a fine of an amount set forth by Council from time to time for noncompliance.

   (F)   Regarding §§ 92.074, any charge for service remaining unpaid 20 days after the billing date shall be deemed delinquent and a late payment penalty of an amount set forth by Council from time to time of the unpaid charge for that billing shall be assessed. In the event that any such delinquent charge remains unpaid for 12 months, an additional penalty equal to interest at the rate of an amount set forth by Council from time to time per annum of the billing shall be assessed.

   (G)   Whoever violates any provisions of §§ 92.070 through 92.081, for which no other penalty is provided, shall be fined an amount set forth by Council from time to time.
