§ 73.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be fined an amount set forth by Council from time to time for each offense.

   (B)   Any parent or guardian of any minor under the age of 16 who knowingly allows such minor to ride a bicycle without wearing a helmet, in violation of § 73.49, is guilty of a misdemeanor, and, upon conviction thereof, shall be fined an amount set forth by Council from time to time.

   (C)   (1)   Any violation of § 73.65(A) constitutes the commission of a misdemeanor criminal offense, and the Police Department of the city, or any other officer of any other police agency exercising proper jurisdiction within the corporate limits of the city, is hereby authorized and empowered to issue a citation and to charge any person who commits a violation of said § 73.65(A), jurisdiction thereof being in the Municipal Court of the city.
      (2)   Any person being convicted of a first offense established hereunder shall be fined an amount set forth by Council from time to time, plus applicable court costs.
      (3)   Any person convicted of a second offense established hereunder shall be fined an amount set forth by Council from time to time, plus applicable court costs.
      (4)   Any person convicted of a third or further offense established hereunder shall be fined an amount set forth by Council from time to time, plus applicable court costs.
