§ 73.49 RIDING ON ROADWAYS AND BICYCLE PATHS.
   (A)   Every person operating a bicycle upon a roadway shall ride as near to the right side of the road way as practicable, exercising due core when passing a standing vehicle or one proceeding in the same direction.
   (B)   Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.
   (C)   Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway.
   (D)   Bicycle helmets.
      (1)   Minors, under the age of 16, must wear a helmet while riding a bicycle on public property.
      (2)   The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this section.
   (E)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      AUTHORIZE. To permit and/or to condone. AUTHORIZATION can be determined either by commission or omission of actions.
      BICYCLE. Every device which does not have a motor attached and which is propelled by human power upon which any person may ride, having two tandem wheels either of which is more than 20 inches in diameter,
      HELMET. A protective, hard gear, designed for the purpose of protecting the skull in the event of an accident.
      KNOWINGLY. To have knowledge of or to be aware of actions occurring.
      MINORS UNDER THE AGE OF 16. Any minor who has not yet reached the age of 16 years old, until, but not including the day of said minor’s sixteenth birthday.
      RIDING. Being on the bicycle and pedaling it to move.
