§ 72.26 CIVIL PENALTIES FOR VIOLATIONS.
   (A)   Civil penalty. Upon receiving a written citation of a violation of § 72.25 above, the owner or operator of the vehicle shall pay a civil penalty in the amount of $5. The civil penalty shall be paid at the town hall within ten calendar days from the date of the citation. If the citation is not paid within the ten calendar days, the civil penalty shall increase to $10. If the citation is not paid within 30 days of the date of the citation, the amount of the penalty shall increase to $20.
   (B)   Immobilization and/or Impoundment of vehicles having unpaid parking tickets.
      (1)   The Chief of Police or his designee may immobilize, by use of wheel locks, or tow or impound any vehicle which is illegally parked and for which there have been two or more previous parking citations issued within the past 30 days. When a wheel lock is attached to a vehicle, a notice shall be affixed to the windshield or other part of the vehicle so as to be readily noticed. The notice shall warn the operator that any attempt to move the vehicle may result in damage to the vehicle. The town shall not be responsible for damage due to someone trying to move an immobilized vehicle. All civil penalties for parking citations, plus a $50 fee for removing the wheel lock shall be paid at the Town Hall within 24 hours of the immobilization or the vehicle is subject to being towed and impounded by the town police.
      (2)   Once a vehicle has been towed and impounded, the investigating officer shall mail or cause to be mailed to the registered owner a “notice of impoundment” which shall include the civil penalties due plus the cost of removing the wheel lock and the towing and impoundment fees.
      (3)   Upon payment of all civil penalties, wheel lock removal and the cost of towing and impoundment at the Town Hall, the vehicle shall be released to the registered owner or to any other person or entity entitled to the possession of the vehicle.
