Pursuant to the authority granted by G.S. 153A-263, there is hereby established a free public library in the town, to be known as the “Elkin Public Library,” and which shall be supported only by gifts and appropriation of nontax revenue available for that purpose, unless under statutory authority, an election is requested or called, and held, at which the voters authorize the levy of a special tax for library purposes.

With the consent of the Board of Commissioners, expressed in each case by an appropriate resolution or ordinance, the Library Board of Trustees may accept any gift, grant, devise or bequest made or offered by any person for library purposes and may carry out the conditions of the donations.

Title to all property given, granted or conveyed, donated, devised or bequeathed to, or otherwise acquired by the town for a library shall vest in and be held in the name of the town, and any conveyance, grant, donation, devise, bequest or gift to or in the name of the Library Board of Trustees shall be deemed to have been made directly to the town.
